Privacy Policy

This privacy notice aims to inform you about the automated processing activities carried out by ByMe. ByMe’s privacy policy governs the use of your personal data, whether through direct contact via our website or contact forms.

1. Who is responsible for processing your personal data?

A) Your personal data is processed by ByMe. You can contact us at helpdesk@byme.pt.

B) ByMe reserves the right to modify or amend this Privacy Policy. Such modifications and changes will be communicated through our website. If you have any questions or comments, you can contact us at helpdesk@byme.pt.

2. What categories of personal data do we process?

A) When you fill in the contact form on our website, or contact us via e-mail, telephone, ByMe collects:

– The basic identity information you provide, such as name, e-mail address and telephone contact.

– The content of your communication and the technical details of the communication itself (date and time, etc.);

– Preferences regarding the receipt of e-mail communications, such as newsletters, announcements, etc;

– Electronic identification data, such as IP address;

– Publicly available information on your Social Media profile and any other personal data you provide to us.

B) Whenever you leave us your business card or interact with us at fairs and events at which we are present, we may collect:

– The basic identity information you provide to us, such as your name, e-mail address, postal address, telephone number, the company you work for and your job title.

3. For what purpose do we use your personal data?

A) ByMe processes your personal data in order to provide you in a personalized and efficient manner with the information, products and/or services you have requested via the Website, e-mail, telephone, trade fairs and events.

B) ByMe processes your personal data in order to communicate with you as a result of our contacting you at a trade fair and/or event or as a result of approaching you via the Website, e-mail or telephone.

C) ByMe processes your personal data to carry out statistical analysis so that we can improve our website, our products and services or develop new products and services.

D) ByMe processes your personal data to comply with legal obligations or to meet any reasonable request from competent law enforcement officials or representatives, judicial authorities, government agencies or bodies, including competent data protection authorities. Your personal data may be transferred on ByMe’s own initiative to the police or judicial authorities as evidence or if there is justified suspicion of an unlawful act or crime committed by you through your registration or use of the Site or other communication with us.

E) ByMe may process your personal data to inform any third party in the context of a possible merger, acquisition of/by or decision of that third party, even if that third party is located outside the EU.

F) ByMe may process your personal data to preserve the legitimate interests of its partners or third parties if and when your registration or use of the Site or other communication channels may be considered (a) a violation of any applicable terms of use or the intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Site, (c) a danger to the Site or any of ByMe’s or its subcontractors’ underlying Systems due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (d) in any hateful, obscene, discriminatory, racist, libelous, malicious or otherwise inappropriate or unlawful manner.

G) ByMe processes your personal data mentioned in clauses 2.A, 2.B above for marketing purposes, i.e. to provide you with targeted communications, promotions, offers and other advertisements from ByMe and selected partners. ByMe will only send communications, promotions, offers, newsletters and other announcements by email or other electronic communication channels from person to person, if you have explicitly consented to receive such communications, newsletters and other announcements.

4. Why is our processing of your personal data legitimate?

A) For the processing of your personal data for the purpose outlined in clause 3.A, we ask for your consent.

B) The processing of your personal data for the purpose outlined in clause 3.D is necessary to enable ByMe to comply with its legal obligations.

C) The processing of your personal data for the purposes outlined in clauses 3.B, 3.C, 3.F and 3.G is necessary for ByMe’s legitimate interests which are:

– To be able to respond adequately to your requests for information and other requests;

– To communicate your personal data to our partners and to provide appropriate information;

– To allow us to defend ourselves in legal proceedings;

– Continuous improvements to the website, social media channels, products and services to ensure you have the best possible experience;

– Keeping our website, social media and products and services safe from misuse and illegal activities;

– Safeguarding our business interests and needs in light of changing market conditions.

– Marketing and promotion of our products, services, brands and successful global marketing of our products and services.

D) In order to process your personal data for the purposes described in clause 3.A, ByMe, as the controller, requests your consent. By consenting to the processing of your personal data for sending communications, promotions, offers, newsletters and other announcements by email or other electronic communication channels from person to person, you agree that we are authorized to process your personal data for this purpose in the manner and under the conditions described in this Privacy Policy.

5. What are our quality guarantees?

A) ByMe makes every effort to process only the personal data that is necessary to achieve the purposes listed under the purpose of processing.

B) Your personal data is processed only for as long as is necessary for the purposes listed above or until such time as you withdraw your consent to process it. ByMe will de-identify your personal data when it is no longer necessary for the purposes described in the purpose of processing, unless there is:

– An overriding interest of ByMe or any other third party in keeping your personal data identifiable;

– A legal or regulatory obligation or a judicial or administrative order that prevents ByMe from de-identifying them.

C) ByMe will take appropriate technical and organizational measures to keep your personal data safe from unauthorized access or theft, as well as accidental loss, tampering or destruction. Access by ByMe personnel or third parties will only be necessary and subject to strict confidentiality obligations. However, security is only a best efforts obligation, which can never be guaranteed.

6. What are your rights?

A) You have the right to request access to all personal data processed by ByMe that belongs to you. ByMe reserves the right to charge an administrative fee for multiple subsequent access requests that are clearly made for causing inconvenience or harm to ByMe.

B) You have the right to request that any of your personal data that is inaccurate be corrected free of charge. If a request for correction is made, such request must be accompanied by proof of the defective nature of the data for which correction is requested.

C) You have the right to withdraw your previous consent, as per clause 4.D, to process your personal data.

D) You have the right to request that your personal data be erased if they are no longer necessary in light of the purposes described above or if you withdraw your consent to process them. However, please note that a request for deletion will be assessed by ByMe against:

– Overriding interests of ByMe or any other third party;

– Legal or regulatory obligations or administrative or judicial orders that may contradict such deletion. Instead of deletion, you may also request that ByMe limit the processing of your personal data if and when: (a) you contest the accuracy of such data, (b) the processing is unlawful or (c) the data is no longer necessary for the purpose described above, but you may need it to defend yourself in legal proceedings.

E) You have the right to object to the processing of personal data if you can prove that there are serious and justified reasons relating to your particular circumstances that justify such objection. However, if the intended processing qualifies as direct marketing, you have the right to object to such processing free of charge and without justification.

F) You have the right to receive in a structured, commonly used and machine-readable format all the personal data you have provided to us.

G) If you wish to submit a request to exercise one or more of the rights listed above, you can send an e-mail to geral@byme.pt for all matters concerning the rights of data subjects. An e-mail requesting the exercise of a right shall not be construed as consent to the processing of your personal data beyond what is necessary to deal with your request. Such a request must clearly state and specify which right you wish to exercise and the reasons for doing so if necessary. It must also be dated and signed and accompanied by a scanned digital copy of your valid identification card proving your identity.

ByMe will promptly inform you of the receipt of such a request. If the request is valid, ByMe shall notify you as soon as reasonably possible.

If you have any complaints about ByMe’s processing of your personal data, you can always contact ByMe at geral@byme.pt. If you remain dissatisfied with ByMe’s response, you are free to file a complaint with the competent data protection authority, i.e. the data protection authority of the country in which you reside or the data protection authority.
